Criminal Law

Criminal law is governed by Indian penal Code, Prevention of Corruption Act, The Scheduled Castes and Tribes (Prevention of Atrocities) Act, Code of Criminal Procedure, Evidence Act etc. Under the law in India, every person who is alleged to commission of Criminal offence is presumed as innocent until and unless allegations are proved against him. It is said that ten criminals may be acquitted, but no innocent person should be convicted.  As contained in Article 14(2) of the International Covenant on Civil and Political Rights, presumption of innocence is a human right although it is not a fundamental right under Article 21 of the Indian Constitution.

A criminal proceeding means proceeding before the court in which the accused is tried for his illegal conduct according to the state’s legislature, or the government.  Generally Criminal cases begin with FIR to the police officer in charge of the police station and/or the person is arrested and informed of their charges of illegal conduct.

Several times it is seen that a person is fraudulently implicated in criminal case with mala-fide intention and is waiting for justice for a long.  On the other side several innocent people are compelled to live in fearful life caused by someone’s criminal activity.
